Ugh. Got my VM Jag and Superego on Friday.

MF was nice enough to send me a used pedal as if it was new. I don't have a problem with used gear when I am buying used gear, but when I buy new gear, I expect it to be new.

Maybe it is new-- this is the first EH pedal I have bought. Do they usually come with 3 warranty cards (one folded in half to fit in a Neo enclosure box), instructions for a Neo Chorus pedal (and the proper instructions), and scratched up adapters? Ok maybe they do. But according to EH, that is not factory-installed velcro residue on the bottom: "Your pedal should not have any residue on the bottom of the unit."

Once you send me used shit as new, I become a picky bitch, and mistrustful one at that. I've bought a bunch of brand new Squiers. I know what the packaging looks like when they're factory sealed. They're getting their guitar back, and they can send me a brand new one.

This one was a return. The likely reason for the original return was that two of three plates were misaligned (and not fixable without filling and drilling), one of the roller pots was loose and able to travel past its normal range, and it had a gouge between the bridge and the edge. The main indicator that it was a return was the condition of the packaging. One of the staples on the factory-sealed box was missing, and a piece of packing tape was holding the torn piece of cardboard where the staple once was. The parts bag had been obviously (and poorly) re-sealed. No problem if I am buying a used guitar, but not if I am buying a brand new guitar.

It obviously wasn't factory sealed or brand new, and that is what I ordered. Sending a used item as if it was new is fraud, no matter the condition of the item. A guitar that someone else possessed and used for up to 45 days is no longer new in the eyes of the law, period. Selling it as new is considered a deceptive practice according to the FTC. Make sure you know your rights as a consumer!

Boo Musician's Friend! A 45 day return policy and no restocking fee is not an excuse to send me anything but factory-sealed, first-quality gear. That is especially true when you consider that I have bought 5 guitars from them since January 2011.
