he's a winner alright!

update on this circuit too: i boxed up a prototype on my day off from tour yesterday... didn't have time to properly test it, but hopefully i can use it tonight in boston! i forgot screws for the bottom plate as well so it looks like i'll be taping it up... wah wah

Zvex has (at least) put the common law trademark symbol on several of his products, as well as the company name. I don't see such marks on references to "Crackle Okay" on his site, but I'd be careful with the naming.

What's inside the box (the circuit) has nothing to do with it. It's the trade name/trade dress issue that may be a problem. I'll bet Mr. Zvex would not like the similarity, and he very likely has legal standing to compel you to change the name of your pedal. His reputation for "letting things slide" is not good. :lol:

I'm not trying to be a parade pisser here, just looking out. :thumb:

i totally appreciate the look out! don't worry, though, i will be very careful and aware. the first thing i did when i thought about naming it that was to look on his site, etc and see if i could find any trademark, copyright, etc... :thumb:

I think the fact that he's been using that phrase in his marketing and on some of the pedals themselves would constitute "prior art".

But I'm not a lawyer. :idk:

I thought he referenced it from somewhere else.....

Whatever, let it happen. The worse thing that happens is he makes you change it after a few batches and they go up in value.

Think of the marketing opportunity! After he makes a big stink and everybody hears about it, you'll have to hire ppl to help you make them, in order to keep up with the demand. :yay:
